Gbyte Terms of Service
Last Updated: September 21, 2026
These Terms of Service (“Terms”) govern your access to and use of Gbyte’s websites, software, applications, products, features, and related services (collectively, the “Services”).
Please read these Terms carefully. By accessing, downloading, installing, purchasing, or using any of the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the Services.
1. About Gbyte and These Terms
The Services are provided by GBYTE TECHNOLOGY LIMITED, with its registered/business address at:
RM A5, 7/F ASTORIA BLDG NO 34
ASHLEY ROAD, TSIM SHA TSUI
HONG KONG
In these Terms, “Gbyte,” “we,” “us,” or “our” refers to GBYTE TECHNOLOGY LIMITED and, where applicable, its affiliates involved in providing the Services.
Payments may be processed by Gbyte affiliates, authorized payment partners, payment processors, or merchants of record. The identity of the entity processing your payment may appear on your checkout page, order confirmation, receipt, or payment statement.
These Terms apply together with any product-specific terms, order information, pricing terms, our Privacy Policy, Refund Policy, and other policies expressly incorporated into these Terms.
If product-specific terms expressly conflict with these Terms, the product-specific terms will apply to the extent of that conflict.
Nothing in these Terms limits any rights that cannot lawfully be excluded or limited under applicable consumer protection laws.
2. Eligibility and Acceptance
You must have the legal capacity to enter into a binding contract to use the Services.
If you have not reached the age of legal majority in your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
By using the Services, you represent that:
- the information you provide to us is accurate and current;
- you are legally permitted to use the Services;
- your use of the Services complies with applicable laws and these Terms; and
- where you access a device, account, backup, or data belonging to another person, you have all permissions or other lawful authority necessary to do so.
3. The Gbyte Services
Gbyte provides software and related services that may include, among other things:
- recovering or extracting data from supported devices, backups, accounts, or storage sources;
- repairing supported mobile operating system issues;
- installing, upgrading, or downgrading supported operating system versions or firmware;
- removing or assisting with certain device access restrictions;
- transferring supported data between devices or platforms; and
- related device management, diagnostic, backup, recovery, and utility functions.
The exact functions available depend on the particular Gbyte product, version, device, operating system, account, region, and subscription or licence purchased.
The product page and checkout page applicable at the time of your purchase describe the principal features included in your licence or subscription.
3.1 Data Recovery
Recovery results depend on factors outside Gbyte's control, including whether data has been overwritten, deleted, synchronized, encrypted, damaged, retained in a backup, made available by a third-party platform, or otherwise remains technically recoverable.
Gbyte does not guarantee that any particular file, message, photo, video, contact, application data, backup, or other item will be recoverable.
A scan identifying an item does not necessarily mean that the item can be successfully restored or exported in complete or usable form.
3.2 System Repair, Upgrades, and Downgrades
System repair, operating system installation, firmware installation, upgrades, downgrades, recovery mode operations, and similar processes may modify system files or device settings and, depending on the operation selected and the condition of the device, may result in data loss.
Certain firmware versions or operating system versions may become unavailable or unsupported because of restrictions or changes imposed by device manufacturers or platform providers.
You should back up important data before performing any operation that may modify your device whenever a backup is reasonably possible.
3.3 Device Unlocking
Any device unlocking or access-related feature may be used only on a device that you own or are lawfully authorized to access.
Certain unlocking procedures may erase some or all data stored on the device.
Availability and effectiveness depend on the device model, operating system version, security configuration, manufacturer restrictions, and other technical factors.
Gbyte does not represent that every type of device restriction, account restriction, activation restriction, carrier restriction, enterprise management restriction, or other security mechanism can be removed.
3.4 Data Transfer
The availability and completeness of transferred data may depend on the source device, destination device, operating systems, application architecture, permissions, file formats, encryption, and restrictions imposed by third-party platforms.
Not every type of data can necessarily be transferred between every supported device or platform.
4. Licence to Use the Software
Subject to these Terms and payment of any applicable fees, Gbyte grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable licence to install and use the applicable software during the period and on the number of devices permitted by your licence or subscription.
Unless your purchased plan expressly permits commercial or professional use, the Services are licensed for your personal and non-commercial use.
You must not:
- copy, distribute, rent, lease, sell, sublicense, publish, or commercially exploit the software except as expressly permitted by Gbyte;
- circumvent licence controls or technical restrictions;
- modify or create derivative works from the software except where expressly permitted;
- reverse engineer, decompile, disassemble, or attempt to derive source code, except to the extent such restriction is prohibited by applicable law;
- remove or alter copyright, trademark, licence, or proprietary notices;
- use one licence on more devices or by more users than permitted by the purchased plan;
- provide paid recovery, unlocking, repair, transfer, or similar services to third parties using a personal licence; or
- use the Services in a way that interferes with or damages Gbyte's systems, infrastructure, or security.
All rights not expressly granted to you remain reserved by Gbyte and its licensors.
5. Authorized Use, Privacy, and Third-Party Rights
You may use the Services only with devices, accounts, backups, data, and other digital content that:
- you own; or
- you are lawfully authorized to access or process.
You must not use the Services to access, scan, retrieve, recover, export, copy, transfer, unlock, monitor, or otherwise process another person's device, account, backup, communications, personal data, files, photographs, messages, location information, or other content without the permissions, consents, or other lawful authority required under applicable law.
You must not use the Services for:
- unauthorized surveillance or monitoring;
- stalking or harassment;
- identity theft or impersonation;
- fraud or deception;
- unauthorized access to devices or accounts;
- interception or unauthorized acquisition of communications;
- circumvention of security measures on a device you are not authorized to access;
- invasion of privacy;
- infringement of intellectual property rights; or
- any other unlawful purpose.
Possessing login credentials, passwords, device access, technical capability, or physical possession of a device does not by itself establish that you are legally entitled to access or process the relevant device or data.
Use of a Gbyte product does not grant you any ownership, privacy, access, or other legal rights in another person's device, account, data, or content.
You are responsible for determining whether your intended use is lawful and for obtaining all permissions, consents, and authorizations required for that use.
If you are uncertain whether you have authority to access another person's device or information, you should obtain appropriate legal advice before using the Services.
6. Your Data and Backups
You retain any ownership rights you already have in data, files, backups, and other content processed using the Services.
Gbyte does not acquire ownership of your personal files merely because you use the Services.
Depending on the product and feature, data may be processed:
- locally on your device or computer;
- through Gbyte infrastructure;
- through cloud infrastructure operated on our behalf; or
- through third-party services necessary to provide a requested feature.
Our collection and processing of personal information is described in our Privacy Policy.
You are responsible for maintaining appropriate backups of important data.
You should not treat Gbyte or any recovery, repair, transfer, or backup function as the sole repository for important information.
Except where prohibited by applicable law, Gbyte is not responsible for data loss resulting from:
- your failure to maintain an appropriate backup;
- pre-existing device or storage damage;
- overwritten or corrupted data;
- hardware failure;
- interruption during a repair, transfer, recovery, upgrade, or downgrade process;
- third-party software or platform restrictions;
- actions taken contrary to instructions provided by Gbyte; or
- circumstances outside Gbyte's reasonable control.
7. Accounts and Account Security
Some Services may require a Gbyte account.
You agree to provide accurate and current account information and to keep that information updated.
You are responsible for:
- maintaining the confidentiality of your account credentials;
- restricting unauthorized access to your account; and
- activities conducted through your account to the extent reasonably within your control.
You must not impersonate another person or create an account using information you are not authorized to use.
If you believe your account has been compromised, contact Gbyte promptly.
We may require reasonable verification before making changes to an account or providing access to sensitive account information.
You may request deletion of your account in accordance with our Privacy Policy and applicable law.
8. Paid Services, Purchases, and Subscriptions
Some Services require payment.
The applicable price, currency, billing period, features, and subscription terms will be displayed before you complete your purchase.
By purchasing a paid Service, you authorize Gbyte and its authorized payment providers to charge the payment method you provide for the amounts disclosed during checkout.
8.1 Subscriptions and Automatic Renewal
Where a product is sold as a recurring subscription, your subscription will automatically renew at the end of each billing period unless you cancel it before the next renewal date.
The applicable billing period may be weekly, monthly, quarterly, annually, or another period clearly disclosed during checkout.
By purchasing an automatically renewing subscription, you authorize recurring charges to your selected payment method in accordance with the subscription terms disclosed to you at purchase.
Your order confirmation or account information may provide instructions or a link for managing or cancelling your subscription.
Cancellation stops future renewals but does not automatically entitle you to a refund for amounts already charged, except where provided by our Refund Policy or required by applicable law.
8.2 Trials and Promotional Pricing
If we offer a free or discounted trial that automatically converts into a paid subscription, the applicable trial period, renewal date, and price will be disclosed before you subscribe.
Unless cancelled before the disclosed conversion date, the subscription may automatically convert to a paid subscription and renew according to the applicable billing terms.
8.3 Price Changes
We may change subscription prices from time to time.
If a change affects the price of an existing recurring subscription, we will provide reasonable advance notice where required by law or appropriate in the circumstances.
The new price will generally apply from a future renewal date rather than retroactively to an already-paid subscription period.
If you do not agree to the new price, you may cancel the subscription before the new price takes effect.
8.4 Taxes and Payment Processing
Applicable taxes, payment processing charges, currency conversion charges, or similar amounts may be added where required and, where applicable, will be disclosed during checkout.
Payments may be processed by third-party payment processors. Their payment services may also be subject to their own terms and privacy policies.
9. Cancellations and Refunds
Refund eligibility is governed by the Gbyte Refund Policy in effect at the time of the relevant purchase, together with any mandatory rights available to you under applicable law.
Any advertised money-back guarantee is subject to the eligibility requirements, exclusions, time limits, and procedures stated in the Refund Policy.
Nothing in the Refund Policy or these Terms excludes a refund or remedy that must be provided under applicable law.
Where a subscription has been cancelled, you may generally continue to use the paid Service until the end of the period for which you have already paid, unless:
- a refund has been issued for that period;
- your access is terminated because of a material breach of these Terms; or
- the applicable product or order terms state otherwise.
10. Third-Party Platforms and Services
Certain Gbyte features may interact with products or services provided by third parties, including device manufacturers, operating system providers, cloud services, app providers, payment processors, or identity providers.
Those third parties are independent of Gbyte and may change their:
- APIs;
- security requirements;
- operating systems;
- authentication procedures;
- backup formats;
- firmware signing policies;
- cloud services;
- technical restrictions; or
- terms of service.
Such changes may affect whether a Gbyte feature continues to work on a particular device, account, operating system, or third-party platform.
To the extent permitted by law, Gbyte is not responsible for third-party products, services, policies, outages, changes, or decisions outside our reasonable control.
Your use of third-party products or services remains subject to the applicable third party's terms.
11. Updates and Changes to the Services
We may release updates, patches, bug fixes, improvements, feature changes, or new versions of the Services.
Updates may be required for continued compatibility, security, or operation.
Because operating systems, hardware, security technologies, and third-party platforms change over time, we do not guarantee that a particular feature will remain compatible indefinitely with every device, operating system version, backup format, or third-party service.
We may modify or discontinue a feature when reasonably necessary for technical, security, legal, regulatory, or business reasons.
Where a material change significantly affects a paid Service during an existing paid subscription period, we will take reasonable steps appropriate to the circumstances and any rights required by applicable law will remain unaffected.
12. Intellectual Property
The Services, including their software, source and object code, interface, visual design, trademarks, logos, text, graphics, documentation, algorithms, and other proprietary materials, are owned by or licensed to Gbyte and are protected by applicable intellectual property laws.
These Terms grant you a licence to use the Services. They do not transfer ownership of Gbyte intellectual property to you.
“Gbyte” and associated names, logos, and branding may not be used without our prior written permission except as permitted by law.
Nothing in these Terms restricts rights expressly granted under applicable open-source licences for any open-source components included in the Services.
13. Feedback
If you voluntarily provide suggestions, ideas, comments, or other feedback about the Services, you grant Gbyte a worldwide, perpetual, irrevocable, royalty-free right to use that feedback for developing, improving, operating, and promoting our products and services.
This provision does not transfer ownership of your private files, recovered data, personal communications, photographs, backups, or other personal content to Gbyte.
14. Suspension and Termination
You may stop using the Services at any time.
We may suspend or terminate access to some or all of the Services if we reasonably believe that:
- you have materially breached these Terms;
- you are using the Services unlawfully;
- your use creates a material security or privacy risk;
- payment required for the Service remains unpaid;
- continued provision of the Service would violate applicable law or a binding legal requirement; or
- suspension is reasonably necessary to protect Gbyte, our users, or third parties from harm.
Where reasonable and legally permitted, we may provide notice before suspension or termination and an opportunity to address the issue.
Termination does not affect rights or obligations that arose before termination.
Sections that by their nature should survive termination, including provisions concerning intellectual property, authorized use, liability, and dispute resolution, will continue to apply.
15. Service Disclaimers
We aim to provide the Services with reasonable care and skill.
However, technology related to data recovery, mobile devices, operating systems, firmware, cloud backups, encryption, and device security involves factors that cannot always be controlled or predicted.
Accordingly, to the maximum extent permitted by applicable law:
- the Services are provided on an “as available” basis;
- we do not guarantee uninterrupted or error-free operation;
- we do not guarantee compatibility with every device, operating system, backup, application, or third-party platform;
- we do not guarantee that any particular data can be recovered;
- we do not guarantee that every system issue can be repaired;
- we do not guarantee that every device restriction can be removed;
- we do not guarantee that every item of data can be successfully transferred; and
- estimates, scanning results, progress indicators, predicted results, success rates, or similar information may not constitute a guarantee of a specific result for your particular device.
Nothing in this section excludes any warranty, condition, obligation, or consumer right that cannot lawfully be excluded.
16. Limitation of Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, these Terms do not exclude or restrict liability for death or personal injury caused by negligence where such liability cannot lawfully be excluded, or any other liability that applicable law does not permit us to exclude or limit.
Subject to the above and to the maximum extent permitted by applicable law, Gbyte and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or purely economic losses that were not reasonably foreseeable when you entered into the contract, including loss of profits, loss of business opportunity, or loss arising from unauthorized or unlawful use of the Services.
For losses that may lawfully be limited, Gbyte's aggregate liability arising out of or relating to a particular paid Service will not exceed the total amount you paid to Gbyte for that affected Service during the twelve months immediately preceding the event giving rise to the claim.
The limitations in this section apply only to the extent that they are fair, reasonable, and enforceable under applicable law.
If applicable consumer law gives you remedies or rights that cannot be excluded, restricted, or modified by contract, those rights remain unaffected.
17. Your Responsibility for Misuse of the Services
You are responsible for your own use of the Services and for complying with applicable law.
If your unlawful or unauthorized use of the Services causes loss, damage, liability, or a third-party claim against Gbyte, you may be responsible for the resulting loss to the extent permitted by applicable law.
For business or professional users, to the extent permitted by law, you agree to indemnify Gbyte against third-party claims, reasonable costs, and liabilities arising directly from:
- your unlawful use of the Services;
- your unauthorized access to another person's device, account, backup, or data;
- your infringement of another person's intellectual property, privacy, or other legal rights; or
- your material breach of Section 5 of these Terms.
This indemnity does not apply to the extent that a claim results from Gbyte's own negligence, breach of contract, or unlawful conduct.
18. Privacy
Your privacy is important to us.
Our Privacy Policy describes how Gbyte collects, uses, stores, shares, transfers, and protects personal information in connection with the Services.
Where applicable, we process personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong) and other data protection laws applicable to the relevant processing activity.
Your use of the Services is subject to the Privacy Policy.
19. Changes to These Terms
We may update these Terms from time to time to reflect:
- changes to the Services;
- changes in law or regulation;
- security requirements;
- changes to our business operations; or
- improvements intended to make these Terms clearer.
When we make material changes, we will take reasonable steps to notify users, such as by updating the “Last Updated” date, publishing a notice on our website or within the Services, or sending a notice to registered users where appropriate.
Changes will not retroactively reduce rights relating to a period for which you have already paid except where required by law, necessary to address a security or legal issue, or otherwise permitted by applicable law.
If you do not agree to revised Terms, you should stop using the Services and, where applicable, cancel your subscription before its next renewal.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
20. Governing Law and Dispute Resolution
These Terms, and any dispute, claim, or non-contractual obligation arising out of or relating to these Terms or the Services, are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to conflict-of-laws principles.
Subject to any mandatory rights available to consumers under applicable law, the courts of the Hong Kong Special Administrative Region shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.
If you are a consumer and the mandatory laws of the jurisdiction in which you reside give you a non-waivable right to bring proceedings in your local courts or receive the protection of particular local consumer laws, nothing in this section deprives you of those rights.
Before commencing formal proceedings, we encourage you to contact us so that we can attempt to resolve the dispute directly.
21. General Provisions
21.1 Entire Agreement
These Terms, together with the applicable Privacy Policy, Refund Policy, order terms, product-specific terms, and other terms expressly incorporated by reference, constitute the agreement between you and Gbyte concerning your use of the Services.
21.2 Order of Precedence
If there is a conflict between these Terms and terms expressly agreed to on a specific order or product page, the more specific terms will apply to that particular purchase or Service, except where doing so would conflict with mandatory law.
21.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
21.4 No Waiver
If Gbyte does not immediately enforce a provision of these Terms, that does not constitute a waiver of our right to enforce it later.
21.5 Assignment
You may not transfer or assign your contractual rights or obligations under these Terms without our prior written consent, except where applicable law gives you such a right.
Gbyte may transfer or assign these Terms as part of a merger, restructuring, sale of business, transfer to an affiliate, or similar transaction, provided that doing so does not unlawfully reduce your rights.
21.6 Force Majeure
Neither party will be responsible for failure or delay caused by events beyond that party's reasonable control, except that this section does not excuse payment obligations that arose before the relevant event.
Such events may include natural disasters, war, civil disturbance, government action, major telecommunications or infrastructure failures, cyberattacks, widespread third-party platform outages, and similar events outside reasonable control.
21.7 Electronic Communications
You agree that notices and communications relating to the Services may be provided electronically, including through email, our website, your account, or the applicable software.
Electronic communications may satisfy legal requirements that communications be in writing to the extent permitted by applicable law.
